Preserving your legacy: The anatomy of estate planning

Without a will or proper nomination, your assets may not go where you intend. This guide explains intestacy, CPF nominations, and how to make your wishes clear.

Estate planning is often deferred because it forces us to confront our mortality. However, it is the ultimate act of stewardship for those you leave behind. Dying intestate (without a will) in Singapore means the state dictates the distribution of your assets according to the Intestate Succession Act. For most, this default rigid distribution structure does not align with their actual intentions, modern family dynamics, or the specific needs of their beneficiaries.

A comprehensive estate plan is far more sophisticated than simply drafting a will. It is a multi-dimensional strategy to ensure wealth is transferred smoothly, tax-efficiently, and privately.

Firstly, consider the Lasting Power of Attorney (LPA). While a will takes effect upon death, an LPA protects you while you are still alive. It legally empowers trusted individuals (Donees) to make decisions regarding your personal welfare and property if you lose mental capacity due to an accident, stroke, or dementia. Without an LPA, your family would have to apply to the courts to manage your affairs-a costly, stressful, and public process.

Secondly, Testamentary Trusts within a will are essential for parents of young children. Leaving a multi-million dollar estate directly to an 18-year-old is rarely prudent. A trust allows you to appoint trustees to manage the funds, stipulating that capital is only released at specific milestones (e.g., funding university, a deposit on a home, or attaining the age of 25), while allowing for maintenance and education expenses in the interim.

Finally, do not overlook your joint assets, insurance policies, and CPF. Life insurance policies can be written in trust under Sections 73 of the Conveyancing and Law of Property Act (CLPA) or Section 49L of the Insurance Act, immediately ring-fencing the payouts from creditors and bypassing the lengthy probate process entirely. Your legacy should be a gift, not a bureaucratic nightmare.
